Informed Consent – Fedhealth Terms and Conditions
Fedhealth wants to empower all of its members to make the best possible healthcare decisions and optimise their medical scheme benefits, to ensure that each beneficiary has a rounded healthcare solution.
In order to ensure we provide all of our beneficiaries with a rounded healthcare solution, we have developed managed healthcare programmes and healthcare initiatives that will facilitate the enhanced management of each beneficiaries’ healthcare needs, with us, healthcare providers, healthcare facilities and all third parties involved on the management of a member’s healthcare solution.
The consent that is provided to us given on behalf of yourself, your minor dependants, your adult dependants who are unable to provide their own consent, and your any other dependant registered on your membership, where you acknowledge and warrant that you have their permission to give such consent
Terms and Conditions of Processing Personal Information:
Definitions:
‘We’, ‘us’, ‘our’ means {medical scheme}
‘you’ and ‘your’ means the user of healthcare services provided and/or your legal guardian
‘Personal Information’ means information that identifies or relates specifically to you, which shall include all health and medical information, personal identification information and benefit information.
‘selected healthcare providers’ means all healthcare providers, with a valid practice number, who have treated you or your dependant in the last 12 months preceding the date of your EHR being activated and uploaded to your EHR.
‘beneficiary’ means a registered member or dependent of Fedhealth entitled to benefits
‘POPI’ means Protection to Personal Act, 4 of 2013.

The Family Room,
any Scheme apps
any third party website or mobile application licensed to us,
managed healthcare programmes,
marketing of medical scheme products.
Maintenance of Consent
Changes by Fedhealth
In the event of there being any changes to these terms and conditions, Fedhealth will advise you with 30 days of these changes being made. It is the member’s responsibility to ensure that these terms and conditions are regularly review so all changes are acknowledged.
Correction of personal information
3.2.1 You confirm that all information provided to Fedhealth at the time of enrolment is true and correct, including all information provided on behalf of any beneficiary registered on Fedhealth who is unable to provide their independent consent.
3.2.2 You acknowledge that any changes to your personal information must be communicated to Fedhealth immediately so these changes can be updated on our systems. Fedhealth will not be liable for inaccurate information on our systems as a result of your failure to update your personal information.
3.2.3 In order to update or manage your consent to view, share, access or the processing of your personal information, you are required to contact Fedhealth to manage the process or you may access information and manage it yourself from the Fedhealth Family Room. Fedhealth will not be liable for inaccurate information on our systems as a result of your failure to update your personal information.
Consent and Compliance in terms of POPI
Your consent is provided to Fedhealth with the acknowledgement and acceptance of the following conditions of personal information usage:
Fedhealth, upon your consent will share your personal information with your selected healthcare providers, Fedhealths partners, service providers and contracted third parties. The consent provided to Fedhealth will be used to:
share your personal health information electronically with your chosen healthcare providers, third parties, your medical schemes administrator and managed healthcare organisation, partners of Fedhealth, service providers of Fedhealth
store your personal health information in a secure cloud based storage facility
process your personal health information for the purpose of maintaining your information, providing your medical scheme services, providing the additional services and sharing your information
use your personal health information for medical research purposes
use your personal health information to optimize your medical scheme benefits
use your personal health information to facilitate Fedhealth benefits in emergency medical situations.
Retain your personal information in terms of the statutory limits
Consequence of consent to sharing of your personal health information
Your personal health information will be electronically transferred and shared with your selected healthcare providers who will be able to access, view and store your personal health information. All reasonable steps are taken by Fedhealth to protect your personal information and maintain your confidentiality. We cannot however, guarantee the security or integrity of any information you transmit to us online and you agree that you do this at your own risk.
You acknowledge that once your personal information is shared by Fedhealth with your selected healthcare providers , Fedhealth will not have any control on your personal information once it has been shared and we will not be responsible for the security of your personal information . Fedhealth complies with the relevant and necessary data protection laws, so while your personal information is under our control we will apply the safety and security measures necessary.
Intended Recipients
The intended recipients of your personal health information are yourself, your selected healthcare providers, specialists and pathologists (including their practice staff in some cases) as well as your appointed broker (in any), Fedhealth, its administrative, clinical service providers, medical care facilities, their relevant affiliates and researchers. Where appropriate emergency medical service providers will have access to your personal health information.
Your personal information can only be provided on your consent and no unauthorised person will have access to your personal information, from Fedhealth, without your consent.
Right to withdraw Consent
The consent provided to the medical for the purpose of accessing, using, transferring, sharing, storing and collecting the personal information of you or your beneficiaries can be revoked at any time. You can revoke consent for any specific healthcare provide, or any other person or provider that has access to your personal information, at any time by contacting Fedhealth. Once this information is captured and updated your personal information will no longer be shared.
Storage of personal information
The personal information of each member will be stored in a “cloud-based” web platform, in a safe and secure environment and the wed-based platform meets the security requirements for POPI and international data protection laws.
Retention of personal information
The personal information of each member will be retained by Fedhealth, administrator and managed healthcare organisation, for the duration of your membership with Fedhealth and after you have left Fedhealth, our personal information will be retained with the allowable statutory limits.
Member Consent
5.1 I agree that by making this information available my medical scheme is not responsible for any loss (whether direct or indirect) that may arise from the use of this information.
5.2 I agree that I may not hold my medical scheme responsible for any loss that may result from the incorrect use or disclosure of the information by my healthcare professional.
5.3 I give permission for my doctor to give my medical scheme my diagnosis and other relevant clinical information required in terms of my medical scheme membership and benefit services.
5.4 I confirm that I have had an opportunity to receive and read (or have read to me) and I fully comprehend the terms, conditions and consequences of these terms and conditions.
5.5 I have been made aware of all the terms printed in bold by Fedhealth and I have had sufficient opportunity to ask questions about this consent form and have had these questions, if any, answered to my satisfaction by Fedhealth.
5.6 My consent to the terms of this consent form is provided of my own free will without any undue influence from any person whatsoever.
5.7 I confirm that I have permission of my dependant(s) to give their consent, where such consent has been provide and I indemnify Fedhealth against this.
The Fedhealth Family Room website: Terms of use
These terms of use will apply to you if you use the any of our self-service channels: Web-based platform, mobi-site, or our app from any electronic device, i.e laptop, cellphone, and tablet.
These terms of use applies along with the other terms & conditions of your medical scheme that governs our services and our relationship with you. The full range of the self – service channels are available to every member or dependent over the age of 18 years or where your parent or legal guardian’s consent to use the service channels if you are younger than 18 years old*.
This is an important document that sets out the rights and duties between members and your medical scheme who access the medical scheme self - service channels through electronic devices.
1. You are responsible for making sure you have the necessary equipment and software to use the self-service channels
1.1 To be able to access the service channels you must have the necessary hardware, software and access to third-party communication services. You will be responsible for paying the cost of this and the cost of any upgrades that you require. To access your membership profile or medical scheme service online you need to have access to a computer that has an active account with an Internet Service Provider (ISP) and an Internet browser software program.
1.2 To access the app or the mobi-site you need to be activated via your cellphone and cellphone network service provider. You will be responsible for paying the relevant cellphone network service provider charges that you incur when using the service channel. You are responsible for the equipment you use to access the service channels. We have no control over the equipment, software or service providers. It is your responsibility to ensure that you have the necessary anti virus or anti-malware software on your device. We are not responsible for any error or delay that may arise as a result and are also not responsible if you are unable to access the service channels because of your equipment, software or services provided to you by third parties.
2. For your protection and security you must enter the correct access information to identify yourself whenever you use or logon to the service channels
2.1 For your security you will need to enter the correct access information or take any other steps acceptable to us for us to verify your identity and the electronic communications you send us using the self –service channels each time you logon to the service channels.
2.2 You should never reveal your access details to anyone under any circumstances. This includes when you use third party applications and sites. Take note that if you do so you put yourself at risk. In addition third parties will be able to access your confidential information, which include medical and health information. If you information is accessing by any third party app or site, we cannot be held liable for your personal and confidential information being accessed and we will not be liable to you or any other person for any loss or damages, suffer.
3 . Authorised Users act on your behalf as your agent
If you allow an authorised user to access your membership profile using the self-services channel, you give that person the authority to act as your agent and this means that anything the authorised user does or doesn’t do will be attributed to you.
4. Security Recommendations:
4.1 We recommend that you always keep your personal access information secure and do not provide your login details to any person, including employees of the medical scheme.
4.2 Do not leave your devise unattended while accessing your membership profile and always close the site or application when you are not using it
4.3 only download our application from the device application store and verify that it is the original application
4.4 ensure that all networks used to access your application or the website, is a secure network.
4.5 Your medical scheme cannot be held liable or responsible for an unauthorized access to your information that may occur from your electronic device, from your use of the app or other self-service channels where you have been negligent and failed to secure your personal information and access information.
4.6 it remains your responsibility to ensure that all of your personal and medical information stored in the app or on your electronic device from the self-service channels is protected.
